Contractor Wins Jobsite Injury Case

Smith was injured at the King’s residence (which was undergoing construction) by falling through a hole leading into the basement.  The Smiths filed a negligence complaint against the general contractor and the framing subcontractor.  The Court stated that a contractor has a duty to use reasonable care in performing the work.  However, the Court found that the danger of the hole was open and obvious to Smith, and that had he taken reasonable precautions, he could have prevented his own injuries.  (more…)
